User agreement
1. TERMS AND DEFINITIONS
1.1. Website – a collection of related web pages and multimedia content, which are identified with a common domain myrockshows.com.
1.2. User – any person accessing the Website via the Internet.
1.3. Personal account – a special section of the Website, which allows the User to access a personal calendar, personal messages, a list of friends, tracking events, bands and cities.
1.4. Event – concerts and festivals in various music genres.
1.5. Partner – a legal entity or a natural person selling the tickets for relevant Event.
2. SUBJECT OF CONTRACT
2.1. The Website provides the User with information about the past and planned Events, indicating the performing artists / groups, place and date of the Event.
2.2. The Website is informative and provides up-to-date information on Events all around the world. Information on Activities is collected and updated on the basis of data from open sources. The site is not responsible for the full relevance and reliability of the data provided about the Events, including for not providing information about the cancellation or postponement of the Event.
3. RIGHTS AND OBLIGATIONS OF THE OPERATOR OF THE WEBSITE
3.1. The Operator of the Website is not responsible for the quality and conditions of the Events, tickets for which are sold using the Partner's system. All claims of Users concerning the cases of cancellation or the quality of the Event, tickets for which are sold through the Partner's system, are transferred to the Partner for independent consideration. Losses incurred by Users as a result of the above fact shall be reimbursed solely at the expense of the Organizer of the particular Event.
3.2. The Website is informational in nature. The Operator of the Website is not responsible for the accuracy, relevance of the data contained. In case of cancellation, postponement of the Event, all claims must be addressed to the Organizer of the Event.
3.3. The Operator of the Website has the right, with the permission of the User, to send e-mails or push-notifications of informational and advertising nature to the User
3.4. The Operator of the Website undertakes not to transfer the e-mail address and other information about the User to third parties.
3.5. The Operator of the Website has the right at any time to change the terms of this Agreement unilaterally, while ensuring the publication of the amended terms on the Website.
4. RIGHTS AND OBLIGATIONS OF THE USER
The User is obliged:
4.1. to familiarize himself with the internal rules of institutions, tickets to which he acquires (etiquette features, dress code, rules of attendance, etc.).
4.2. ensure the safety of personal data from access by third parties;
4.3. not to disseminate information that is promoting war, inciting ethnic, racial or religious hatred and enmity, as well as other information for the dissemination of which criminal or administrative liability;
4.4. not to disrupt the site;
4.5. not to create multiple accounts on the Website if in fact the same person has its;
4.6. not to commit actions aimed at misleading other Users;
4.7. not to transfer the access to your account and / or login and password of your account to third parties;
4.8. not to post materials of advertising, erotic, pornographic or offensive nature;
4.9. Do not use scripts (programs) for the automated collection of information and/or interaction with the Website.
The user has the right to:
4.10. search for information on the site;
4.11. receive information on the site;
4.12. leave the comments on the Website;
4.13. copy information to other sites with the mark of the source;
4.14. use the site information for personal non-commercial purposes.
5. FORCE MAJEURE
5.1. The parties shall be released from liability for non-performance or improper performance of obligations under the Contract for the duration of force majeure. Force majeure means extraordinary and insurmountable circumstances preventing the PARTIES from fulfilling their obligations under this Agreement. These include natural phenomena; the impact of a nuclear explosion, radiation (ionizing radiation) or radioactive contamination of nuclear weapons materials, industrial and research activities or radioactive waste; war, military invasion, hostile actions of a foreign enemy, military actions, military maneuvers and related activities of a military nature; civil war, armed insurrection, popular unrest of all kinds, mass riots, forcible seizure or forcible retention of power; epidemics, epizootics, weather conditions, terrorist actions, strikes, seizure, confiscation, requisition, nationalization, etc. The Party for which the above circumstances have occurred shall notify the other party of their occurrence as soon as possible. In this case, well-known events do not need any confirmation, for other events it is necessary to attach the relevant supporting documents, which may be, including, but not limited to, documents emanating from the competent state authorities.
6. PROCEDURE FOR CONSIDERATION OF CLAIMS AND DISPUTES
6.1. All disagreements or disputes that may arise will, if possible, be settled by the parties through negotiations.
6.2. If agreement for any reason is not reached during the pre-trial settlement, the dispute arising from this Agreement shall be subject to judicial review at the location of the Operator of the Website.
6.3. Claims of the User on the provided Services are accepted and considered by the Operator of the Website in info@myrockshows.com.
